Discrimination is "Krystal" Clear at Krystal Restaurant

BLACK RESTAURANT WORKERS SUE OVER STRIP SEARCH: Managers of Ga. venue accused of unfairly targeting black employees over missing money.

*Four black former employees of a north Georgia restaurant say they were unfairly strip searched by white managers and that three of them were fired after they complained, reports Fox News.

The federal agency's complaint says managers searched the four employees after $100 disappeared from a white employee's cash register at the Krystal restaurant in Winder in June 2005.

Herbert Hunter, Daphne Hill and Shannon Jackson say they were fired after they complained that only black employees were strip searched. Quinthony Brown did not return to work after he was searched.

The Equal Employment Opportunity Commission has filed a lawsuit on their behalf, seeking back wages plus interest.

"We don't want any other employee subjected to this kind of treatment," Vincent Hill, the EEOC attorney handling the case, told the Athens Banner-Herald.

The employees complained to the EEOC two months after the alleged incident, and the agency has been working to negotiate a settlement with New Capital Dimensions, the Milledgeville-based company that formerly owned the Winder franchise of the Krystal chain that operates across the South.

FEMA: SYNONYM FOR "FOOL"

WASHINGTON - The homeland security chief on Saturday tore into his own employees for staging a phony news conference at the Federal Emergency Management Agency.

"I think it was one of the dumbest and most inappropriate things I've seen since I've been in government," Michael Chertoff said.

"I have made unambiguously clear, in Anglo-Saxon prose, that it is not to ever happen again and there will be appropriate disciplinary action taken against those people who exhibited what I regard as extraordinarily poor judgment," he added.

Asked specifically if he planned to fire anyone at FEMA, which is part of his department, Chertoff declined to say, citing personnel rules.

"There will be appropriate discipline," he told reporters at a news conference with New York's governor where they announced an agreement on a driver's license plan.

Chertoff said he knew nothing about the matter until after it happened and that he "can't explain why it happened."

The White House on Friday scolded FEMA for the faux press conference about assistance to victims of wildfires in southern California.
The agency — much maligned for its sluggish response to Hurricane Katrina over two years ago — arranged to have FEMA employees play the part of reporters at the event Tuesday and question Vice Adm. Harvey E. Johnson, the deputy director.

The questions were soft and gratuitous.

"I'm very happy with FEMA's response," Johnson said in reply to one query from an agency employee.

FEMA gave reporters only 15 minutes notice about Tuesday's news conference. But because of the short notice, the agency made available an 800 number so reporters could call in. Many did, although it was a listen-only arrangement.

Johnson said in a statement Friday that FEMA's goal was "to get information out as soon as possible and in trying to do so we made an error in judgment."

"Our intent was to provide useful information and be responsive to the many questions we have received," he said. "We can and must do better."

If you performed your assigned tasks, at optimal level there would be no need to "fake a news conference!"

FEMA, are you implying that no improvements have been made since Hurricane Katrina??

It's insulting to believe that A GOVERNMENT AGENCY would go to such great lengths to pull off a ruse such as this!!

Advocates for Faith and Freedom filed a lawsuit with the Federal District Court in San Diego on behalf of several employees whose constitutional right of equal access was denied by the Superior Court of San Diego when they were forced to stop using a weekly meeting place for their lunchtime Bible study.

In April 2006, Mindy Barlow and Dalia R. Smith, court employees for the Superior Court, were told that their Bible study group could not meet in an empty jury room or courtroom during the lunch hour, even though other groups are allowed to use the court's facilities.
The Bible study group had been meeting since 2000 when the court initially gave them permission. Six years later, they were suddenly and arbitrarily denied use, forcing them to seek further approval.

Meanwhile, the court instituted a policy requiring all individuals, groups, or organizations seeking to use court facilities to submit an application. When the Bible study participants submitted their application, the courts denied their request, stating that approval of the Bible study would violate the separation of church and state.

"The constitutional rights of these court employees cannot be ignored simply because they work for the state," said Advocates' Legal Counsel, Jennifer Monk. "This Bible study should be given access to court facilities in the same manner as other groups, regardless of the -fact that they meet to study the Bible."

By rejecting the court employees' right to hold a Bible study, the San Diego Superior Court has directly violated the group members' First Amendment rights of free speech and free exercise of religion. The lawsuit accordingly asks the Federal District Court to declare the policy implemented by the courts unconstitutional and, in doing so, to allow the Bible study to resume meeting in court facilities.

Robert Tyler, General Counsel for Advocates for Faith and Freedom commented: "It is not too surprising when government agencies misapply applicable constitutional principles, but this is the Superior Court of California - they should know better."
